TERMS AND CONDITIONS OF THE ONLINE STORE
CHAPTER 1. GENERAL PROVISIONS
GENERAL PROVISIONS
The online store GardenDekory operating in the Shopify environment is operated by P.H.U. BEGAPOL Przemysław Garbień is operated by P.H.U. BEGAPOL Przemysław Garbień, with its registered office at: Rudnik, ul. Centralna 246, 32-440 Sułkowice, Poland, NIP: 6811846366, contact phone number: +48 666 489 123.
These Terms and Conditions define the rules for making purchases in the online store, in particular the rules and procedure for concluding distance sales agreements via the Store, as well as the complaint procedure and the procedure for withdrawal from the agreement by the Consumer.
With regard to services provided electronically, these Terms and Conditions constitute the regulations referred to in Article 8 of the Act of 18 July 2002 on the provision of electronic services.
The Terms and Conditions are addressed to all Customers of the Store. All Customers are obliged to familiarize themselves with the provisions of the Terms and Conditions before making a purchase.
Each Customer is obliged to comply with the provisions of these Terms and Conditions. Sales are conducted on the basis of the version of the Terms and Conditions in force at the time the order is placed.
Each Customer may access the Terms and Conditions at any time via the “Store Terms and Conditions” section available on the GardenDekory Shopify Store website.
All information contained on the Store’s website relating to products (including prices) does not constitute an offer within the meaning of the Polish Civil Code, but an invitation to conclude an agreement. By submitting the Order Form, the Customer submits an offer to purchase and deliver the selected Product at the price and under the conditions specified in the product description.
CHAPTER 2. DEFINITIONS
Terms and Conditions – these regulations governing the use of the Store’s services by Customers.
Consumer – a natural person concluding an agreement via the Store, not directly related to their business or professional activity.
Entrepreneur with Consumer Rights – a natural person concluding a civil law agreement via the Store directly related to their business activity, when the agreement does not have a professional nature for that person.
Customer – a natural person (including a Consumer), legal entity, or organizational unit without legal personality using the services provided by the Store.
Order Form – a service available on the GardenDekory Shopify Store website through which the Customer may make purchases, including adding Products to the Cart and specifying the terms of the Sales Agreement.
Cart – an element of the Store in which the Products selected by the Customer are visible and where the Customer may modify the Order details.
Store – the online service available under the domain GardenDekory Shopify Store through which the Customer may purchase Products.
Seller – P.H.U. BEGAPOL Przemysław Garbień, with its registered office at: Rudnik, ul. Centralna 246, 32-440 Sułkowice, Poland, NIP: 6811846366.
Product / Goods – movable items offered for sale in the Store.
Goods with Digital Elements – goods containing or connected with digital content or a digital service in such a way that the absence of such content or service would prevent proper functioning.
Agreement – a distance sales agreement concluded between the Customer and the Seller via the Store.
CHAPTER 3. ORDER ACCEPTANCE AND FULFILLMENT
The condition for using the Store is familiarization with and acceptance of these Terms and Conditions. By placing an order, the Customer accepts the Terms and Conditions.
The main parameters determining the ranking of offers presented to Consumers in search results are:
- popularity of the offer,
- purchase history,
- random display of bestselling offers.
The Store marks sponsored offers and paid advertisements in a visible manner.
The Seller applies individualized price adjustments based on automated decision-making.
The price indicated in the order constitutes the total gross amount payable by the Customer. Delivery costs are not included and depend on the selected delivery method.
The Seller reserves the right to change prices, introduce new Products, conduct and cancel promotional campaigns, or make changes thereto in accordance with applicable law.
Orders are accepted:
- via the Order Form available at GardenDekory Shopify Store,
- by e-mail.
Orders may be placed 24 hours a day, 7 days a week.
The Customer places an order by selecting the Product, adding it to the Cart, completing the Order Form, selecting the delivery and payment method, and confirming the purchase.
After placing the order, the Customer receives an e-mail confirmation.
The sales agreement is concluded once the Customer receives confirmation of order acceptance.
Orders are processed on business days from Monday to Friday.
Delivery Costs
- Standard shipping: The order costs are given in the advertisement for orders below EUR 100.
- Free delivery for orders above EUR 100.
CHAPTER 4. DELIVERY AND SHIPPING COSTS
Orders are delivered via:
- GLS courier,
- personal pickup.
The estimated delivery time is usually 2–5 business days.
The Seller is not responsible for delays caused by the carrier.
Upon receipt of the shipment, the Customer should:
- verify the contents and completeness of the shipment,
- inspect the external packaging and Product condition,
- prepare a damage report together with the courier in the event of damage.
Personal pickup is available at: ul. Topolowa 20, 32-447 Siepraw, Poland.
CHAPTER 5. PAYMENT METHODS
The following payment methods are available in the Store:
- Credit/debit card payments processed via Przelewy24 (PayPro S.A.),
- BLIK mobile payments,
- Klarna deferred or installment payments,
- Przelewy24 online bank transfers,
- Cash on delivery (COD).
Transactions are secured using SSL/TLS encryption and payment operators compliant with PCI DSS standards.
The Store does not store payment card details or bank login credentials.
The Customer is obliged to make payment when placing the order unless a deferred payment method has been selected.
Orders paid by traditional bank transfer must be paid within 5 business days from the order date.
CHAPTER 6. COMPLAINTS
The Seller is liable for any lack of conformity of the Product with the Agreement in accordance with applicable consumer laws.
The Seller is liable for any lack of conformity existing at the time of delivery and revealed within 2 years from delivery.
If the Product is non-conforming, the Consumer may request repair or replacement.
The Seller shall perform the repair or replacement within a reasonable time and without excessive inconvenience to the Consumer.
If repair or replacement is impossible or excessively costly, the Consumer may request a price reduction or withdraw from the Agreement.
Complaints may be submitted:
- in writing to: ul. Topolowa 20, 32-447 Siepraw, Poland.,
- via e-mail.
The complaint should include:
- Customer details,
- description of the defect,
- order number,
- proof of purchase (optional).
Complaints are processed within 5 business days.
CHAPTER 7. RIGHT OF WITHDRAWAL
Pursuant to consumer protection laws, the Consumer may withdraw from the Agreement without providing any reason within 14 days from the date of receiving the Product.
To exercise the right of withdrawal, the Consumer must submit a clear statement informing the Seller of the decision to withdraw.
The Product should be returned within 14 days from withdrawal.
The Consumer bears only the direct costs of returning the Product.
The Seller shall refund all payments received, including the standard delivery costs, within 14 days from receipt of the withdrawal statement, but may withhold the refund until the returned Product is received.
The right of withdrawal does not apply in cases specified by law, including:
- customized Products,
- sealed Products opened after delivery for hygiene reasons,
- digital content delivered electronically after consent to immediate performance.
The right of withdrawal also applies to Entrepreneurs with Consumer Rights.
CHAPTER 8. OUT-OF-COURT DISPUTE RESOLUTION
If the complaint procedure does not bring the expected result, the Consumer may use out-of-court complaint and redress procedures, including:
- mediation before the Trade Inspection Authority,
- consumer arbitration courts,
- assistance of municipal or district consumer ombudsmen,
- the EU ODR online dispute resolution platform.
CHAPTER 9. PERSONAL DATA PROTECTION
The administrator of personal data provided by Customers is:

Personal data is processed solely for the purpose of order fulfillment and customer service, in accordance with Regulation (EU) 2016/679 (GDPR).
Providing personal data is voluntary but necessary for order processing.
Customers have the right to access, correct, or delete their personal data.

CHAPTER 10. FINAL PROVISIONS
These Terms and Conditions define the rules for concluding and performing sales agreements for Products available in the Store.
The sales agreement is concluded between the Customer and the Seller.
The Terms and Conditions are available electronically on the GardenDekory Shopify Store website.
The Customer is prohibited from posting unlawful content on the GardenDekory Shopify Store website.
In matters not regulated herein, applicable provisions of Polish law shall apply.
If any provision of these Terms and Conditions is found invalid or ineffective, the remaining provisions shall remain in full force and effect.
